Marbella Moves Toward a Modern Urban Planning Framework
What the new planning reform means for investors and developers
Marbella has taken an important step toward replacing the outdated planning framework that has governed development in the city for decades.
The regional government of Andalucía has recently granted approval to Marbella’s new PGOM (Plan General de Ordenación Municipal), the strategic planning document that will guide how the municipality develops in the coming decades.
For investors and developers, this reform could bring something Marbella has lacked for years: greater legal certainty around zoning, land use and development permissions.
However, the key point is timing. The reform will not transform the planning landscape overnight. Its impact will unfold gradually over the next few years.
Why Marbella Needed a New Planning System
Marbella has been operating under a complex planning situation for many years.
The city technically reverted to its 1986 planning framework after the newer plan approved in 2010 was annulled by Spain’s Supreme Court in 2015.
This created an unusual scenario where a modern international property market was governed by regulations written nearly forty years ago.
The result was often:
• legal uncertainty around some developments
• confusion over zoning classifications
• slower planning approvals
• increased due diligence for investors
The new planning framework aims to modernise this system and provide clearer rules for future development.
The New Planning Model
Under Andalucía’s LISTA planning law, Marbella’s new system separates planning into two key documents.
PGOM – Strategic Planning Framework
The PGOM defines the overall urban model for the municipality.
It establishes:
• land classifications
• long term development strategy
• infrastructure planning
• environmental protections
This is the document that has now received regional approval.
POU – Detailed Development Rules
The second document, known as the POU (Plan de Ordenación Urbana), will contain the detailed planning rules developers actually work with.
It will define:
• building heights
• development density
• zoning permissions
• urbanisation requirements
Until the POU is fully approved, many technical planning details will continue to operate under transitional rules.
Expansion of Development Land
One of the most relevant aspects of the reform is the planned expansion of land classified as urban or developable.
The new framework could increase urban land in Marbella to roughly 53 million square metres, with approximately 12 million additional square metres becoming available for development.
This could create new opportunities for:
• residential development
• mixed use projects
• hospitality and tourism projects
In a market where demand for property continues to grow, this expansion is likely to attract strong interest from developers.
Regularising Existing Properties
Another important objective of the reform is addressing the legal status of properties built under previous planning ambiguities.
Marbella has thousands of homes constructed during earlier development periods where zoning classifications were unclear.
Providing mechanisms to normalise many of these properties could:
• improve legal security for owners
• simplify property transactions
• increase access to financing and mortgages
Timeline: When the Reform Will Actually Matter
While the reform is moving forward, its practical impact will take place in stages.
The key milestones are:
2026
Final municipal approval of the PGOM is expected. This establishes the new strategic planning framework for Marbella.
2026 to 2027
Approval of the POU, which will define the detailed development rules.
From 2027 onward
The new planning system is expected to become fully operational in practice.
For investors and developers, the most important moment will be when the POU is implemented, as this is when the detailed zoning and building permissions become clear.
What This Means for Investors and Developers
For many years, planning uncertainty has been one of the main obstacles when evaluating development projects in Marbella.
The new framework has the potential to improve this environment by providing:
• clearer zoning rules
• greater legal certainty
• additional development land
• more predictable planning procedures
However, the real impact will depend on how efficiently the system is implemented at municipal level.
The Bottom Line
Marbella’s planning reform represents one of the most significant structural changes to the city’s development framework in decades.
While the transition will take time, the direction is clear: a move toward modern planning rules and greater legal clarity.
For developers and investors watching the Costa del Sol, the key period to monitor will be between now and 2027, when the new planning system is expected to become fully operational.
